Face Pay Terms
These terms and conditions (“Terms”) govern your use of the GCash Face Pay feature on the GCash App (“Face Pay”). By using Face Pay, you agree to these Terms and the GCash App Terms which are deemed incorporated herein and shall apply suppletorily insofar as they are not inconsistent with these terms.
Face Pay is an innovative payment solution that allows you to make secure and seamless transactions and conveniently pay for products and services at partner-merchant stores using biometric facial recognition technology. By eliminating the need for physical payments using cash, cards, or devices, Face Pay offers both merchants and customers a faster, contactless, and more convenient and efficient payment experience. This service integrates advanced facial recognition software with GCash’s secure payment processing system, ensuring reliable and accurate transactions at the point of sale.
Please read these Terms carefully before using Face Pay.
In these Terms, references to “GCash,” “we,” “us,” and “our” refer to G-Xchange, Inc., including its directors, officers, employees, affiliates, representatives, partners, successors, and assigns. References to “User,” “you,” and “your” refer to the user of Face Pay.
These Terms are effective upon your acceptance and use of Face Pay service. Your continued use of the Service constitutes your ongoing and continuous acceptance of these Terms for each and every transaction you conduct using Face Pay.
1. Eligibility
To use Face Pay, you must be a fully verified user and have fully activated Face Pay.
2. Payment Authorization
By using Face Pay, you authorize us to: (a) charge your GCash wallet for the total amount of your purchase, and (b) share transaction details with our partner merchants as necessary to complete the payment.
5. Privacy
Your use of Face Pay is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the Smile-to-Pay, you consent to our Privacy Policy, available at Privacy Notice.
6. Limitations of Liability
The product or service is solely provided by the merchant. GCash makes no representations or warranties of any kind, express or implied: (i) about the quality, quantity, completeness, fitness for a particular purpose, and/or results of the merchant’s product or service paid for by the User through Face Pay. Any availment of the product or service by you is at your own risk, and you release GCash from any damages or liabilities. Any questions or concerns regarding the products or refund should be raised directly with the merchant.
We shall not be held liable for any losses, claims, or damages incurred by you due to unsuccessful transactions caused by technical failures affecting Face Pay, except in instances where such failures are solely and directly due to the willful misconduct or gross negligence of GCash.
8. Modifications to the Smile-to-Pay
We reserve the right to make Face Pay available to specific users or all users at any given time or period, and to modify or discontinue the service at our discretion, with or without prior notice.
